dc.description.abstractTürkiye Denetim Standartları ve Kamu Gözetimi Kurumu Kanunu, AB müktesebatı ve ABD’de yaşanan muhasebe skandalları sonucunda çıkarılan SOA’ya genel anlamda uyum sağlayan pek çok sayıda çağdaş yenilik ve düzenlemeyi de beraberinde getirmiştir. Kanunun genelinin, AB müktesebatıyla paralellik arayışı içinde ele alındığı ve bu kapsamda önemli mesafe kat edildiği görülmektedir. Ancak gerek oluşturulan Kurumun yapısı, gerekse Kurumun yetki alanının ABD uygulamalarından çok daha kapsamlı bir şekilde tasarlanmış olması uygulamada bazı sorunlara yol açabilecek durumdadır. Kanun ile tesisi planlanan yapının, kamu tüzel kişiliğini haiz idari ve mali özerkliğe sahip bir kurum olarak kurulması yerine, TÜRMOB’un çatısı altında bir yapılanmaya gidilmesinin daha uygun olacağı yönünde sektör temsilcilerinin talepleri bulunmaktadır. Bu çalışmada 6 Nisan 2011 tarihli ve 6223 sayılı Kanun'un verdiği yetkiye dayanılarak, Bakanlar Kurulu'nca 26 Eylül 2011 tarihinde kararlaştırılmış ve 2 Kasım 2011 tarih, 28103 sayılı Resmi Gazete'de yayımlanarak yürürlüğe giren Türkiye Denetim Standartları ve Kamu Gözetimi Kurumu’nun Amerika Birleşik Devletleri (ABD) ve Avrupa Birliği (AB)’nde ki benzer kurumlarla karşılaştırılması yapılmıştır.
dc.description.abstractTurkey Auditing Standards and Public Oversight Authority Act, the EU acquis and accounting scandals in the United States experienced a large number of modern innovations and regulations that conforms generally to have been brought about as a result of SOA removed. General of the Act, as discussed in parallel with the EU acquis and the quest Significant progress has been achieved in this context. However, the structure of the organization should be created, as well as the jurisdiction of the Authority is designed in a more comprehensive way the US administration is able to cause some problems in practice. In this study, 6 April 2011 and based on the authorization given by the 6223 the Law Council of Ministers agreed on 26 September 2011 and 2 November 2011, and 28103 numbered Official Gazette enacted Turkey Auditing Standards and Public Oversight Authority America United States (US) and European Union (EU) in which were compared with similar institutions.
