Özet
Maverdi, Hukukçu, Tefsirci, Edebiyatçı, Siyasetçi bir alimdir. Hukuk sahasında Şafi mezhebini takip etmiştir. Kendisinden pek çok kimse ders almış, rivayette bulunmuştur. Eserlerinin çoğunluğu İslam Hukukunun amme (devlet) ile ilgili kısmını oluşturmuş ve bu alanda söz sahibi olmuştur. El-Ahkamü's Sultaniyye önceki fıkıh kitaplarında devlet idaresine dair yazılmış olan dağınık bilgileri bir araya getirerek idarecilere yardımcı olması bakımından sahasının en önemli eserlerindendir. Mâverdî, eserini kaleme alırken, yaşadığı dönemden önce geçmiş olan dört asırlık kamu hukuku uygulamalarını, devlet yönetimine ait örf ve âdetleri büyük ölçüde göz önünde bulundurmuştur. Öncelikle Allah'ın Resulü'nün uygulamalarını, dört meşhur halifenin devlet yönetimi ile ilgili uygulamalarını önemle dikkate almıştır. Engin siyasî ve diplomatik tecrübesiyle gerek kendisine kadar gelmiş olan meşru uygulamaları, gerek dinî kurallardan çıkardığı siyasî, idarî, kazaî hükümleri eserine yansıtmıştır. Konuları işlerken genellikle dört mezhebin fıkhî görüşlerini tarafsız olarak vermiş ihtilaflı konularda Şafi Mezhebinin görüşlerini kabul etmiştir. El-Ahkamü's Sultaniyye, Maverdi'nin halka bakışını, alanının en önemli eserlerinden ve İslam amme Hukukunun temel kaynaklarından olması sebebiyle İslam Hukuku içerisinde halkın yerini göstermesi açısından bizi bu konu üzerine çalışmaya yöneltmiştir.
Maverdi is a scholar besides being jurist, annotator, man of literature and politician. He followed sect of Shafii in the field of law. Many had been hiz students and had referred to him in their works. Majority of his works is about `the pulic side? ofwas an arbiter in this field. His book Al-Ahkamu?s Sultaniyye compiled dispersed information about state administration of the previous islamic canon law books to direct and help administrators of the state and it was the most important work of its field. Mâverdî considered public law practices of previous four centuries, consuetudes and customs of state administration while forming his book. He paid special attention to the Prophet Muhammed?s (upon him be peace) and his four chaliphs? practices about state administration. He reflected legal practices upto his time besdides political, administrative and judial decisions that he derived from religious rules by his vast political and diplomatic experience. He gave unbiasedly the opinions of four İslamic sects in discussing the topics and accepted opinions of Shafii sect for the topics at issue. That Al-Ahkamü?s Sultaniyye is the most important work of the field besides being one of fundemental sources of İslamic public law and that it reflects the position of public in İslamic law besides point of view of Maverdi about public has headed us to study on this topic.
