Özet
Dünyamız sanayileşme sonrası toplumsal bir gerçeklik olarak ortaya çıkan çevre sorunlarıyla karşı karşıyadır. Çevre sorunları arasında bugün dünyayı tehdit eden en önemli gelişmelerden birisi, kuşkusuz küresel ısınma ve buna bağlı olarak ortaya çıkan iklim değişikliğidir. Küresel ısınma ve iklim değişikliği yönündeki verilerin güçlü bir şekilde ortaya konmasından bu yana, bu tür bir felaketin boyutları ve buna yönelik alınması gereken önlemler tartışılmaktadır. Küresel bir sorunun, ancak küresel çapta işbirliği ile çözülebileceği anlayışından hareketle, Avrupa Birliği’nin hem birlik içinde hem de dünya genelinde bu konuda önemli girişimleri bulunmaktadır. Avrupa Birliği’nin, başta emisyon gazlarının sınırlandırılması yönündeki çabaları, onu ekonomik, kültürel ve siyasal liderliği ile birlikte, çevre sorunlarının çözümünde de dünyada çapında öncü bir konuma getirmiştir. Çevre sorunlarının ortaya çıkmasında ve bugünkü boyutlara ulaşmasında sorumluluklarının bilincinde gözüken Avrupa Birliği’nin, kendi kurumları aracılığıyla sorunlara çözüm aramaktadır. Ancak, bu kurumların çalışmasında ve karar almasında, bir yandan üye devletlerin çıkarları diğer yandan artan çevre sorunları, zaman zaman tereddütler yaşanmasına ve karar mekanizmalarınıntıkanmasına neden olmaktadır. Bu çalışma, AB’nin iklim sorunları çerçevesindeki çabalarını ve hukuksal düzenlemelerini incelemektedir.
The world faces with many environmental problems that have occurred as social phenomena after industrialisation. Changes in the world climate that occur as the result of the global warming are the most important environmental issues among others. Today the negative impacts of the global warming and climate change are generally recognised and the possible solutions for them are considered and discussed. In this context the EU takes initiatives about this matter both for the EU and for the world based on the believe that global problems could be solved only with the measures taken at the global level. Thus the EU seems to be aware of its responsibilities for the environmental problems and seeks solutions for them. However, the increasing density and complexity of environmental problems, and the priority given their interests over environmental issues by individual member states cause difficulties in decision-making processes. This paper considers the activities and legal arrangements of the EU about climate issues. …
